Avandia® Heart Attack Lawyer

A recent report by the United States Senate Finance Committee has concluded that Avandia®, the diabetes drug manufactured by pharmaceutical giant GlaxoSmithKline™ poses a strong risk of heart attacks among its users. It is also learned that the company was aware of Avandia® side effects for years, but kept quiet, as tens of thousands of Americans suffered heart attacks.
In its 334 page report, the Committee has also criticized the Food and Drug Administration, for overriding safety concerns that were previously highlighted by its own staff.

Committee Chairman, U.S. Senator Max Baucus has expressed that "Americans have a right to know there are serious health risks associated with Avandia® and GlaxoSmithKline™ had a responsibility to tell them." Further, in a letter to the FDA and GlaxoSmithKline™, questioning their astounding negligence, Baucus stated "What we are learning about the handling of Avandia® by both GlaxoSmithKline™ and the FDA is appalling and unacceptable. Both the drug company and the FDA have some major explaining to do about what they knew about Avandia®, when they knew it, and why they didn't take immediate action to protect patients. The number one priority for drug manufacturers and the FDA must be patient safety."

Avandia® Side Effects

Avandia® has been one of GlaxoSmithKline's™ most profitable drugs. The drug was introduced in 1999, and by 2006, it had emerged as one of the most profitable drugs in the pharmaceutical industry. Over 11 million prescriptions were written, and by 2006, it had generated gross sales of almost $3 Billion for GlaxoSmithKline™.

Essentially, there are two key components to any drug on the market: effectiveness and safety. Avandia®, was effective in combating combat "type 2" diabetes, however it brought too many cardiovascular risks, such as heart attacks, to be classified as a safe drug. Had GlaxoSmithKline™ made the appropriate disclosures to FDA and highlighted that its trials were not sufficiently adequate and broad to test Avandia side effects totally, the FDA may have adopted a more cautious approach while approving the drug.

Findings on the harmful side effects of Avandia® were available as early as May 2007. The New England Journal of Medicine (NEJM) had reported in an article dated May 21, 2007 that "treatment with rosiglitazone (Avandia®) was associated with a significant increase in the risk of myocardial infarction, and an increase in the risk of death from cardiovascular causes that was of border-line significance...our findings are worrisome because of the high incidence of cardiovascular events in patients with diabetes."

The report also added that in susceptible patients, who have had exposure to Avandia® for short periods of time, "rosiglitazone therapy" may even be "capable of provoking myocardial infarction or death from myocardial causes after short-term exposure." The article also highlighted that "the manufacturer's public disclosure of summary results for rosiglitazone clinical trials is not sufficient to enable a robust assessment of cardiovascular risks."

GlaxoSmithKline™ furthered its negligence by keeping the truth away from the public and has failed to protect the safety and interests of its consumers. The scope and extent of the information it did not disclose is appalling. As Baucus aptly noted in his commentary "Patients trust drug companies with their health and their lives and GlaxoSmithKline™ abused that trust."
