The Social Security (DIB) and Supplemental Security Income (SSI) disability programs are the largest of several Federal programs that provide assistance to people with disabilities. Only individuals who have a disability and meet medical criteria may quality for benefits under either Social Security Administration program.
- Social Security Disability Insurance (DIB) pays benefits to you and certain members of your family if you are “insured,” meaning that you worked long enough and paid Social Security taxes. If you become disabled and are no longer able to work, you may be eligible to receive benefits from the Social Security Administration. Benefits are not automatically granted by Social Security just because you or your doctor says that you can no longer work. The Social Security Administration has rules that pertain to benefits (www.ssa.gov/disability). Once you apply for benefits, you must follow a specific and involved process before the Social Security Administration decides if you are eligible for benefits. If Social Security decides in your favor, it may still take months before you are awarded benefits and even longer before you receive any money.

If you do hire someone to represent you, the Social Security Administration restricts the amount of money they will withhold from your award to pay your representative’s fees. Your representative’s fees are paid out of any back pay, typically your first check that may be awarded to you. However, you will not continue to pay your representative out of your monthly disability checks.
Handling the claim yourself can be a daunting task. The process takes a lot of time and can be very frustrating. You will have to prove why you cannot work, not just at your past job, but at any other job in the national economy. The burden of proof is on you. Social Security Disability Insurance is exactly that—insurance. It is not in their best interest to approve claims. In fact, most claims are denied the first time. If your claim is denied, you can appeal. Most appeals are denied. You can appeal again and you can request a hearing. In some parts of the country it may take more than a year before you have a hearing date. If you get a hearing date, you will have to present your case before a Social Security Administrative Law Judge. The Judge may ask for medical experts you have never met to give opinions about whether or not you can work.
